Midvale is a city of renters. 57% of its households rent their home, against 34% across Salt Lake County. Only about a third of its homes are stand-alone houses, against 60% countywide. When you rent, the lease decides a lot about who fixes a broken appliance. So the first two questions below are about Utah’s rental law.

Midvale questions

I rent. Who pays to fix the fridge or the washer?
Start with your lease. A landlord must maintain appliances “as specifically contracted in the rental agreement,” Utah’s Fit Premises Act says. So if your lease says the landlord provides and keeps up an appliance, its repair is the landlord’s. If the appliance is yours, so is the repair. The law also says renters must use appliances in a reasonable manner. And a landlord and a renter can move a duty from one to the other in a written agreement they both sign.

My landlord won’t fix an appliance the lease covers. What can I do?
Utah’s Fit Premises Act sets out a written notice. It has to describe each problem, and say the landlord has 10 calendar days to fix something the lease requires. It also has to name the remedy you choose and let the landlord in to make the repair. And it has to be served the way the law or your lease says. If the landlord takes no substantial action toward a fix in those 10 days, your chosen remedy applies. With rent abatement, the lease ends, and you owe no rent from the date of the notice. You then have to move out within 10 calendar days after the landlord’s 10 days run out. With repair and deduct, you can fix it yourself and take what you paid off future rent, up to two months’ rent. Keep the receipts, and give the landlord copies within five days after your next rent period starts. Neither remedy applies if you or a guest caused the problem, or if you aren’t meeting your own duties under the law. The law also leaves out breakdowns that don’t materially affect your health or safety. Read it before you send a notice.

Will Midvale’s bulky waste pickup take an old appliance?
It will, if the city collects your garbage. Midvale runs the curbside pickup in the spring and the fall, with a set date for each trash day. Its Bulky Waste page has the dates. Set items out no more than a week early, and by 6:30 a.m. on the day. The city collects appliances without Freon. A fridge or freezer goes only once a licensed professional has removed its Freon, the cooling gas, and tagged it. Homeowners associations don’t contract with the city for trash, so HOA residents don’t qualify.
